PRIVACY POLICY

This Policy has been divided into different sections based on different categories of data subjects, i.e. the individuals whose personal data is processed by BRENDERUP. Therefore, you only need to read the section that is relevant to you and that refers to the category to which you belong.

 

1. PERSONAL DATA LIABILITY

1.1 PERSONAL DATA POLICY

The personal data policy (this "Policy"), describes how Brenderup Group AB, Rundelsgatan 16, 211 36 Malmö, Sweden, or the company within the Brenderup Group with which you have entered into an agreement or are in contact with (hereinafter "BRENDERUP", "we", "us", "our"), collect, use, share, store or otherwise process personal data.

1.2 PERSONAL DATA LIABILITY

BRENDERUP is the data controller for the processing of your personal data and is responsible for ensuring that the processing takes place in accordance with applicable legislation.

1.3 YOUR PRIVACY

Your privacy is important to us and we work hard to comply with applicable data protection legislation and to protect your rights. This Policy describes, among other things, what information we collect about you, how your personal data is processed and for what purposes we collect and use your personal data as well as what rights you have under the General Data Protection Regulation (GDPR).

If you are dissatisfied with our processing of your Personal Data, please contact us and we will do our best to accommodate your comments. Your privacy is very important to us and we always strive to process your Personal Data in the best and safest possible way. If you believe that we are lacking in our ambitions, you have the right to submit any complaints regarding our processing of your Personal Data to the Swedish Authority for Privacy Protection (IMY).

 

2. PROTECTION OF YOUR PERSONAL DATA

2.1 PERSONAL DATA

Personal Data is any information relating to an identified or identifiable natural person that can directly or indirectly identify a person ("Personal Data").

2.2 YOUR PERSONAL DATA

You should always feel safe when you submit your personal data to us. BRENDERUP has therefore taken the necessary security measures to protect your personal data against unauthorized access, change and deletion.

2.3 PROTECTION OF YOUR PERSONAL DATA

We protect your Personal Data by using appropriate safeguards to prevent loss, improper use, disclosure, alteration and destruction. These measures include encrypting data, firewalls, automatic timeouts, and one-time access links that expire after a few hours. Therefore, you can trust that your Personal Data is in safe hands.

 

3. YOUR RIGHTS

3.1 AS REGISTERED

As a data subject, you have rights under GDPR, which are set out below. When you wish to exercise your rights, you are welcome to contact us using the contact details set out in section 1.4 of this Policy. 
When you want to exercise your rights, our starting point is to follow your request and get back to you no later than one month after you contacted us. The processing can take up to three months if the volume or complexity of the case requires it. If so, we will notify you. We will always respond to your request in writing. 
Depending on the legal basis on which we support our processing and the purpose of the processing, there may be exceptions or limitations to your ability to exercise your rights. 
If the request is manifestly unreasonable or unfounded, in particular in view of its recurrent nature, we may either charge a fee or refuse to comply with the request. In that case, we shall be able to show that the request is manifestly unfounded or unreasonable.

3.2 RIGHT OF ACCESS AND REGISTER EXTRACT

You always have the right to know what Personal Data we process about you and to have access to a copy of this Personal Data, a so-called register extract.

3.3 REQUEST CORRECTION OF INCORRECT DATA

You have the right to request that the controller have incorrect personal data concerning you rectified without undue delay. Depending on the purpose of the processing, you also have the right to supplement incomplete personal data.

3.4 REQUEST DELETION

You have the right to request that your data be deleted. Upon such a request, we delete data that is no longer necessary to process or retain for the purpose for which the data was collected. We also delete your data if you withdraw your consent for a processing. In some cases, we have no possibility to delete your personal data. In that case, it is because the data is either still necessary to process for the purpose for which it was collected, that our interest in continuing to process the data outweighs your interest in having it deleted, or because we have legal requirements to keep it.

3.5 REQUEST THAT PROCESSING BE RESTRICTED IN CERTAIN CIRCUMSTANCES

In special circumstances (as set out in applicable data protection legislation), you have the right to ask BRENDERUP to  restrict the use of your Personal Data or delete your Personal Data. 

3.6 REQUEST THE RIGHT TO DATA PORTABILITY

You also have the right to data portability. This means a right, under certain conditions, to obtain and transfer your Personal Data in a structured, commonly used and machine-readable format to another personal data controller.

3.7 RIGHT TO OBJECT TO PROCESSING

You have, on grounds relating to your particular situation, the right to object at any time to the processing of personal data concerning you based on Article 6 (1) (f) of the General Data Protection Regulation, legitimate interest.

3.8 WITHDRAWAL OF CONSENT

If BRENDERUP  processes Personal Data based on your consent, you have the right to withdraw your consent at any time by written notice to BRENDERUP.

 

4. IF YOU EMAIL US

4.1. GENERAL

This section applies to you who, either as an individual or representative of your company, have sent e-mails to an employee or any other of BRENDERUP's representatives.

4.2 WHAT TYPES OF PERSONAL DATA DO WE PROCESS?

We collect Personal Data in the form of your name, email address and other information that you voluntarily share in emails you send to us.

4.3 HOW DO WE PROCESS PERSONAL DATA THAT WE RECEIVE IN AN EMAIL?

Upon receipt of an email, we will make an assessment as to  whether we have any reason and legal basis under sections 5, 6 or 7 to store or otherwise continue to process the Personal Data received. If we determine that such reason and legal basis exists, we will continue to process the received Personal Data in accordance with sections 5, 6 or 7, as applicable. Otherwise, we will delete the Personal Data received through the email.

 

5. IF YOU ARE A CUSTOMER OF BRENDERUP OR ARE OTHERWISE IN CONTACT WITH US AS A PRIVATE PERSON

5.1. GENERAL

This section applies to you who are a customer of BRENDERUP or  are otherwise in contact with us as a private person, regarding our products or services.

5.2 WHAT TYPES OF PERSONAL DATA DO WE PROCESS?

5.2.1 If you are a BRENDERUP customer
We process Personal Data about you in the form of name, e-mail address, home address, telephone number, social security number, information about your driver's license and personal data entered on your driver's license including a picture of you, information about your current and previous use of our products or services including any ongoing rentals, accidents, late payments, user account and password if you use any online account that we provide,  details of requests you have submitted and other information you have voluntarily shared with us.

5.2.2 If you are a private customer of BRENDERUP'swebshop
We process Personal Data about you in the form of name, e-mail address and telephone number,

5.2.3 If you are not a BRENDERUP customer
We process such Personal Data that you have voluntarily shared with us, such as your name and e-mail address.

5.3 WHY DO WE PROCESS YOUR PERSONAL DATA?

5.3.1 If you are a BRENDERUP customer
We process your Personal Data to provide our products or services and to administer the agreement with you. Furthermore, we process your contact information to market and otherwise inform you about our business, our products, services and the like.

5.3.2 If you are a private customer of BRENDERUP'swebshop
We process your Personal Data to provide our products and services and to administer the agreement with you within the framework of BRENDERUP'swebshop. If you have consented to it, we also process your contact information to market and otherwise inform you about our business, our products, services and the like.

5.3.3 If you are not  a customer of BRENDERUP or  a customer who is interested in additional products or services from us
We process your Personal Data to respond to inquiries about future agreements regarding the provision of our products or services. Furthermore, we process your contact information to market and otherwise inform you about our  business, our products, services and the like. 

5.4 LEGAL BASES FOR PROCESSING YOUR PERSONAL DATA

5.4.1 If you are a BRENDERUP customer
The legal basis for our processing of your Personal Data for the purpose of providing our products or services and administering the agreement with you is that the processing is necessary to fulfill the agreement with you. Furthermore, the processing for marketing/information purposes is based on our legitimate interest in informing about our business.

5.4.2 If you are a private customer of BRENDERUP'swebshop
The legal basis for our processing of your Personal Data for the purpose of providing our products or services and administering the agreement with you within the framework of BRENDERUP'swebshop is that the processing is necessary to fulfill the agreement with you. If you have consented to it, we also process your contact information to market and otherwise inform you about our business, products, services and the like based on the legal basis consent.

5.4.3 If you are not  a customer of BRENDERUP or  a customer who is interested in additional services or products from us.
The legal basis for our processing of your Personal Data for the purpose of responding to inquiries about future contracts is that the processing is necessary to take steps prior to entering into a contract with you. Furthermore, the processing for marketing/information purposes is based on our legitimate interest in informing about our business.

5.5 HOW LONG DO WE SAVE YOUR PERSONAL DATA?

5.5.1 If you are a BRENDERUP customer
Your Personal Data will be stored for the duration of the contractual relationship. In addition, BRENDERUP will  save the Personal Data to the extent necessary to establish, enforce or defend against legal claims. 

5.5.2 If you are a private customer of BRENDERUP'swebshop
Your Personal Data will be stored for as long as the contractual relationship lasts, i.e. with regard to the statutory complaint period of two years. In addition, BRENDERUP will  save the Personal Data to the extent necessary to establish, enforce or defend against legal claims.

5.5.3 If you are not  a customer of BRENDERUP or  a customer who is interested in additional services or products from us
Your Personal Data is stored only for the time necessary to fulfill the purposes for which the data was collected in accordance with this Policy. Furthermore, the Personal Data will be deleted if
(i) you notify us that your interest in our products and services has ceased,
(ii) the provision of the relevant product or service is interrupted by BRENDERUP, or
(iii) you request that we delete your Personal Data
Please note, however, that if you are a BRENDERUP customer,  your Personal Data will be retained in accordance with section 5.5.1.

5.6 WHO DO WE DISCLOSE YOUR PERSONAL DATA TO?

5.6.1 If you are a customer of ours, we may share your Personal Data with our trusted subcontractors to the extent necessary for us to perform the contract we have entered into with you. These may need to be given access to the Personal Data to carry out their assignment from us, but they will not be entitled to process the Personal Data for any other purpose. Furthermore (and regardless of whether you are a customer or not), some of BRENDERUP'sservice providers, including suppliers of IT systems, may be given access to your Personal Data.  When BRENDERUP  engages suppliers to process your  Personal Data on BRENDERUP's behalf, it may engage a personal data assistant to process Personal Data on BRENDERUP's behalf, the suppliers are to be regarded as data processors within the meaning of the General Data Protection Regulation.   BRENDERUP is responsible for ensuring that the personal data processor's processing is in line with the  legal requirements that apply to the processing, which is met by BRENDERUP giving the personal data assistants instructions in personal data assistant agreements that are established with all the processors.

5.6.2 BRENDERUP will not sell or lend your personal data to third parties.

5.6.3 Unless otherwise stated in any specific information regarding our processing of your Personal Data, BRENDERUP will not  transfer your Personal Data to any country outside the EU/EEA.

5.6.4 Personal data may be disclosed by BRENDERUP if  required by law or regulatory requirements or if it is necessary for us to safeguard our legal interests or to detect or prevent fraud or other security issues.

 

6. IF YOU REPRESENT A COMPANY THAT HAS A CONTRACTUAL RELATIONSHIP WITH BRENDERUP OR IS OTHERWISE IN CONTACT WITH BRENDERUP

6.1. GENERAL

This section 4 applies to you who are employed by or otherwise represent a company with which BRENDERUP has  an ongoing contractual relationship, or with which BRENDERUP has established contact to discuss the possibilities of such a contractual relationship or for any other purpose. 

6.2 WHAT TYPES OF PERSONAL DATA DO WE PROCESS?

We collect and process the following Personal Data about you:
(i) contact information, i.e. name, e-mail address, telephone number,
(ii) employment information, i.e. employer, job title, address of workplace, and
(iii) other information that you intentionally share, e.g. information about you that you voluntarily enter in free text fields or share in other contexts.

6.3 WHY DO WE PROCESS YOUR PERSONAL DATA?

We process your Personal Data for the following purposes:
(i) to send you notifications or notices related to an agreement between your company and BRENDERUP;
(ii) to otherwise be able to perform, maintain and perform our obligations under a contract with your company;
(iii) to discuss any future contractual relationships between your company and Brenderup; or
(iv) to provide you with information about BRENDERUP'sproducts or services, or to invite you to activities or events.

6.4 LEGAL BASES FOR OUR PROCESSING OF YOUR PERSONAL DATA

The processing carried out in accordance with section 4.3 is based on our legitimate interest to (as applicable) :
(i) maintain, maintain and administer a contractual relationship that we have with your company;
(ii) maintain the cooperation/partnership with your company and provide your company with relevant product, solution or service offerings; and
(iii) market, promote and inform about our business, products, solutions, services, events and the like.

6.5 HOW LONG DO WE SAVE YOUR PERSONAL DATA?

6.5.1 If your company has a contractual relationship with us, we will save your Personal Data in our database until the contractual relationship with your company ends. However, we will continue your Personal Data (if these are specified in the text of the contract) as part of the contract text, as long as the agreement is saved for the purpose of securing BRENDERUP'slegal interests.

6.5.2 If we have discussions with your company but such discussions do not result in a contract, we will delete your Personal Data from our databases when they are no longer needed for the said discussions.

6.5.3 If we have not started any discussions with your company but are interested in providing your company with marketing material and other information about our business, products, solutions, events, etc., we will process your Personal Data for a period of 3 years, after which we will delete the Personal Data (unless discussions regarding a future collaboration have been initiated). Furthermore, we will delete your Personal Data that we use for direct marketing purposes if you object to our processing for such purpose. 

6.6 WHO DO WE DISCLOSE YOUR PERSONAL DATA TO?

6.6.1 BRENDERUP may share your Personal Data with our trusted subcontractors to the extent necessary for us to be able to perform the agreement we have entered into with your company. These may need to be given access to the Personal Data to carry out their assignment from us, but they will not be entitled to process the Personal Data for any other purpose. Furthermore, some of BRENDERUP's service providers, including IT system providers, may be given access to your Personal Data.  BRENDERUP may engage a data processor to process Personal Data on BRENDERUP's behalf.  BRENDERUP is  responsible for ensuring that the personal data assistant's processing is in line with the legal requirements that apply to the processing.

6.6.2 BRENDERUP will not sell or lend your personal data to third parties.

6.6.3 Unless otherwise stated in any specific information regarding our processing of your Personal Data, BRENDERUP will not  transfer your Personal Data to any country outside the EU/EEA.

6.6.4 Personal data may be disclosed by BRENDERUP if  required by law or regulatory requirements or if it is necessary for us to safeguard our legal interests or to detect or prevent fraud or other security problems.

 

7. IF YOU APPLY FOR A POSITION AT BRENDERUP

7.1. GENERAL

This section applies to you who apply for a position at BRENDERUP; either an advertised vacancy or by submitting a spontaneous application. We welcome all applications and are curious about everyone who applies to join us! 

7.2 WHAT TYPES OF PERSONAL DATA DO WE PROCESS?

We will process personal information and contact information about you, which we have requested or which you have provided in writing or orally. We will not collect any Personal Data about you from any third party. The personal and contact information consists of name, date of birth, address (including email address), telephone number, current position (if any) and CV (including picture if you have included a picture of you in your resume).

7.3 WHY DO WE PROCESS YOUR PERSONAL DATA?

BRENDERUP processes Personal Data about you in order to assess your job application and to decide if we want to offer you a service at Brenderup.

7.4 LEGAL BASES FOR OUR PROCESSING OF YOUR PERSONAL DATA

7.4.1 Application for an advertised vacancy or if you proceed to a job interview The legal basis for processing Personal Data that we receive in connection with a recruitment process regarding an advertised vacancy, or if, after a spontaneous application, you proceed to a job interview is that the processing is necessary to take steps before an (employment) contract with you is concluded.

7.4.2 Unsolicited application and Personal Data stored for future recruitment processes
The legal basis for processing Personal Data that we receive through a spontaneous application in cases where we have no vacancies to offer, or that we store after a completed recruitment process (in relation to a position that has been assigned to another applicant) is your consent that you have given to such processing.

7.5 HOW LONG DO WE SAVE YOUR PERSONAL DATA?

7.5.1 Your data will be stored for as long as the recruitment process is ongoing and for a subsequent period of 1 year, during which Brenderup will retain the Personal Data to defend itself against any legal claims.

7.5.2 If our processing of your Personal Data is based on your consent, we will retain your Personal Data until you withdraw your consent. However, we will in any case delete your Personal Data if our purpose of processing the data ceases.

7.6 WHO DO WE DISCLOSE YOUR PERSONAL DATA TO?

7.6.1 Only those of BRENDERUP'semployees and, where applicable, external recruiters who are directly involved in a relevant recruitment process will be given access to your Personal Data. Furthermore, some of BRENDERUP's service providers, including IT system providers, may be given access to your Personal Data.  BRENDERUP may engage a personal data assistant to process Personal Data on  BRENDERUP's behalf.  BRENDERUP is  responsible for ensuring that the personal data assistant's processing is in line with the legal requirements that apply to the processing.

7.6.2 BRENDERUP will not sell or lend your personal data to third parties.

7.6.3 Unless otherwise stated in any specific information regarding our processing of your Personal Data, BRENDERUP will not  transfer your Personal Data to any country outside the EU/EEA.
